Terms & Conditions

01 . Acceptance & Binding Agreement

These Terms & Conditions (the “Terms”) form a legally binding agreement between you and WaggingGoods (“we,” “us,” or “our”). By browsing, registering, or purchasing, you represent that you are at least 18 years old and have full legal capacity to enter into this agreement.

If you do not agree to these Terms, please stop using the site and do not place an order.

02 . Changes to These Terms

We may modify, replace, or discontinue these Terms, our products, our pricing, or any feature of the site. Changes take effect when posted, and your continued use after posting constitutes acceptance of the revised Terms. Changes do not apply retroactively to orders already placed.

03 . Pricing, Orders & Acceptance

All prices are shown in U.S. dollars and are subject to change. We reserve the right to refuse, cancel, or limit any order, including for suspected fraud, pricing errors, resale, or excessive quantities.

In the event of a pricing or typographical error, we may cancel affected orders even after confirmation, and will refund the charge in full as our sole obligation.

04 . Memberships & Recurring Billing

Where you enrol in a membership such as Prickle Patch VIP, or any auto-refill or subscription, you authorise us to charge your payment method on a recurring basis until you cancel. Charges renew automatically at the then-current rate, and we will tell you in advance of any change to that rate.

You may cancel at any time through your account or in writing to main@mkvcompany.business. Cancellation stops future renewals; you remain responsible for charges already incurred, and partial billing periods are not pro-rated.

05 . Acceptable Use

You agree not to misuse the site, including by attempting unauthorised access, scraping, reselling our products without written authorisation, interfering with security features, or submitting false information. We may suspend access and cancel orders for a suspected violation.

06 . Intellectual Property

All content on this site — including logos, product names, images, text, and design — is the property of WaggingGoods or its licensors. You are granted no licence to use, copy, or reproduce it without our prior written consent.

07 . Safe Use of Wearable Pet Carriers

Please read this section carefully. Our wearable carriers, including the Nestling Sherpa Carry Hoodie, are designed to carry a small pet in a front pouch while you are walking or standing. They are comfort garments, not safety restraints.

By purchasing, you agree that:

• The pouch is intended for small pets, typically under 15 lb. Do not carry a pet heavier than the pouch is designed for.
• You will support your pet with a hand when bending, leaning, climbing or descending stairs, or moving over uneven ground.
• The carrier is not a crash-tested restraint. Do not use it while driving, cycling, riding a motorcycle, skating, running, or during any activity where a fall is foreseeable.
• You will not leave a pet unattended in the pouch, and will not use it for a pet that is unwell, injured, pregnant, distressed, or prone to biting or bolting.
• You will inspect the garment before each use and stop using it if seams, stitching, or the pouch show wear or damage.
• You are responsible for monitoring your pet's comfort, temperature, and breathing while they are in the pouch, and for removing them if they show any sign of distress or overheating.

You assume the risks inherent in carrying an animal on your body, including the risk that a pet may move, jump, or fall. If you are unsure whether the product suits your pet, ask your veterinarian before use.

08 . Safe Use of Toys & Other Products

Our toys are pet accessories, not indestructible, and are not a substitute for supervision. Always supervise your pet during play and inspect items regularly for wear, discarding any item that is damaged or has loose parts that could be swallowed.

09 . Disclaimer of Warranties

Except as expressly stated in these Terms or required by law, the site and all products are provided “as is” without warranties of any kind, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted or error-free.

10 . Limitation of Liability

To the maximum extent permitted by law, WaggingGoods and its officers, employees, and suppliers shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or data. Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded.

11 . Indemnification

You agree to defend, indemnify, and hold harmless WaggingGoods from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your violation of these Terms, or your violation of the rights of a third party.

12 . Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. We ask that you contact us first so we can try to resolve any dispute directly.

Any dispute that cannot be resolved informally shall be settled through final and binding individual arbitration seated in Sealy, Texas. You waive any right to a jury trial and to participate in a class action or class-wide arbitration. Claims must be brought within one (1) year of the event giving rise to them. This section does not prevent either party from bringing a claim in small claims court, and does not limit any non-waivable right you have under the consumer law of your country or state.

13 . Severability & Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force. Our failure to enforce a right is not a waiver of it. These Terms, together with our Privacy Policy, Shipping Policy and Refund & Returns Policy, constitute the entire agreement between you and WaggingGoods.
